3. Judgment dated 7th August, 2012 (Annexure-1) passed by learned 2nd Additional District Judge, Puri in F.A.O. No.54/142 of 2010-2005 is under challenge in this writ petition, whereby dismissing the appeal, it confirmed the order dated 23rd September, 2005 (Annexure-3) passed by learned Civil Judge (Senior Division), Puri dismissing I.A. No.162 of 2005 (arising out of C.S. No.265 of 2005) under Order XXXIX Rules 1 and 2 C.P.C.

4. Since none appears for the parties, this Court feels that they have lost interest in pursuing the matter.

5. Accordingly, this writ petition stands dismissed for non- prosecution.
