                   3.        1.      This matter is taken up through hybrid mode.

2. This RPFAM has been fled assailing the judgment dated 16th July, 2018 (Annexure-2) passed by learned Judge, Family Court, Dhenkanal in Cr.P. No.55 of 2017, whereby the Petitioner has been directed to pay maintenance of Rs.1,000/- per month to the Opposite Party No.1-wife and Rs.500/- per month to each of the Opposite Party Nos.2 and 3 till they attain the age of majority with effect from the date of the application, i.e., 19th May, 2017.

3. Mr. Acharya, learned counsel for the Petitioner files a memo in Court stating that the brief has been taken back from him. As such, he has no instruction in the matter.

4. It appears that there is delay of 478 days in filing the RPFAM. Although an application in IA No.49 of 2020 was filed for condonation of delay, but the same has not yet been moved.

5. In that view of the matter, the IA No.49 of 2020 is dismissed for non-prosecution. Consequentially, the RPFAM stands dismissed being barred by limitation.
