4. 1. This matter is taken up through hybrid mode.
2. Judgment dated 21st April, 2017 (Annexure-3) passed by learned Judge, Family Court, Berhampur, Ganjam in Criminal Proceeding No.271 of 2014 is under challenge in this RPFAM, whereby allowing an application under Section 127 Cr.P.C., the Petitioner has been directed to pay maintenance at the enhanced rate of Rs.3,500/- per month to the Opposite Party from the date of filing of the application, i.e., from 10th December, 2014.
3. Mr. Panigrahi, learned counsel for the Petitioner submits that the matter has become infructuous in the meantime.
4. Mr. Mohapatra, learned counsel for the Opposite Party submits that the matter may not be infructuous in view of the facts and circumstances of the case.
5. Taking into consideration the submission of Mr. Panigrahi, learned counsel for the Petitioner that the matter has already become infructuous, the RPFAM is disposed of as such without interfering with the impugned order under Annexure-3.
