01. 1. Learned counsel for the Appellants contends that the case of the Respondent is not covered on the judgment dated 17th August, 2021 in W.P.C.(OAC) No.3077 of 2014 (Mamata Manjari Mohanty v. State of Orissa) since in the present case, the Respondent was appointed by an Authority, who had no power to do so.

2. Notice both on the application for condonation of delay limitation as well as the writ appeal be issued to Respondent by Speed Post/Registered Post with A.D., making it returnable before the next date. Requisites be filed within three working days. The tracking report be placed on record before the next date.

3. List on 17th July, 2023.

4. In the meanwhile, till the next date, there shall be stay of the impugned order of the learned Single Judge. Issue urgent certified copy of this order as per rules.
