        5.       1.      This matter is taken up through hybrid mode.

2. Judgment dated 24th December, 2012 passed by learned Judge, Family Court, Berhampur at Ganjam in Criminal Proceeding No.1197 of 2010 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.500/- per month to each of the Opposite Parties from the date of filing of the petition, i.e., from 28th March, 1997.

3. Mr. Ojha, learned counsel being authorized by Mr. Dutta, learned counsel for the Petitioner by filing a memo submits that they have no instruction in the matter. Memo is taken on record.

4. In view of the memo filed, the RPFAM is dismissed for non-prosecution.
