33. 1. Mr. Panigrahi, learned senior advocate, appears on behalf of appellant and submits, his client is aggrieved with impugned judgment dated 7th August, 2009 whereby challenge of his client to the award stood rejected. Drawing attention to the award he points out that the first claim on deduction against retention money, there was award for compensation, when the contract specifically provided for no interest to be paid.
2. Mr. Sanganeria, learned advocate appears on behalf of respondent.
3. Appellant will file the contract to demonstrate its contention from relevant clauses therein.
4. List on 22nd March, 2022, as prayed for by Mr. Panigrahi.
