02. 1. This matter is taken up through hybrid arrangement.

2. Heard learned counsel for the parties.

3. The petitioner has filed this writ petition seeking a

direction from this Court to the opposite parties to

sanction Trained Graduate Scale of Pay to him on

completion of 48 years of age in terms of the Orissa

Education (Recruitment and Conditions of Service of

Teachers and Members of The Staff of Aided Educational

Institutions) Rules, 1974 and also in terms of the

judgment passed by this Court in the case of Radharani

Samal -vrs.- State of Orissa and others 1.

4. In such view of the matter, let notice be issued to the

opposite parties.

5. Mr. Debasis Mohapatra, learned Standing Counsel for

the Department of School and Mass Education waives of

notice on behalf of the opposite parties. Required number

of copies of the writ petition be served on him in course

of the day, who shall obtain instructions in the matter

and file reply.

6. List this matter on 8th of August, 2022.
