3. An extra copy of brief be served on learned counsel for the State within three working days hence, who shall obtain instructions in the matter and apprise the Court on the next date.

5. In the meantime, learned counsel for the petitioner is directed to deposit cost of paper book.

6. List this matter on 22.03.2022 for final hearing.

02. 1. This is an application for bail under Sections 389(1) of the Cr.P.C. read with Chapter VI Rule 27(a) of Orissa High Court Rule.

2. The petitioner has been convicted under Sections 13(2) and 13(1)(c) of the Prevention of Corruption Act and Section 409 of the IPC by the learned Special Judge (Vigilance), Balangir vide judgment dated 13.12.2021 in C.T.R. No.4 of 2015. He has been sentenced to undergo imprisonment for two years under Section 409 of the IPC and to pay a fine of Rs.10,000/- in default to undergo imprisonment for three months.

3. It is submitted that the petitioner is in custody from the date of his arrest. Keeping that in view, the petitioner-Dijaber Dalbehera be released on bail by the court in seisin over the matter on such terms and conditions as deemed just and proper.

4. In view of the above, the I.A. is disposed of.

5. As the restrictions due to resurgence of Covid-19 are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the Advocate concerned with his/her seal, in the manner prescribed vide Court's Office Order dated 7th January, 2022.
