3. Mr. Subhankar Rout, learned counsel appearing for the petitioner on instructions of Mr. A. Sanganeria, learned counsel for the petitioner submitted that vide Annexure-12, a representation filed by the petitioner has been disposed of, holding that the contract does not contain any clause of escalation and the liability that has cropped up.

4. The matter shall be heard on merit on the next date. The counsel for the petitioner is directed to produce the copy of the judgment passed in the earlier writ petition W.P.(C) No.13817 of 2016.
