09. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. Mr. N. Panda, learned counsel appearing on instruction of Mr. A.K. Das, learned counsel for the respondent has prayed for a short accommodation as Mr. Das, learned counsel is unwell.

3. Prayer stands allowed.

4. Let the matter be listed on 13.01.2023.

5. Meanwhile, the Opposite Party may file the objection, if any against the prayer for leave to appeal against the Judgment and order of acquittal dated 08.09.2005.

6. It is made absolutely clear that if by the next date no such objection is filed by the respondent, no further accommodation will be made. The matter will be taken up for disposal on merit.
