           2.        1.      This matter is taken up through Hybrid mode.

2. Petitioners in this RPFAM seek to assail the judgment and order dated 3rd August, 2022 (Annexure-2) passed by learned Judge, Family Court, Phulbani in Criminal Proceeding No.27 of 2018, whereby he rejected an application to proceed with an application filed under Section 128 Cr.P.C. in terms of the ratio in Asian Resurfacing of Road Agency Private Limited and another Vs. Central Bureau of Investigation, reported in (2018) 16 SCC 299.

3. In view of disposal of RPFAM No.275 of 2018 by order of the event date, no further order is required to be passed in this RPFAM, as there is no legal impediment on the part of learned Judge, Family Court to proceed with the execution case in terms of order passed today in RPFAM No.275.2018.

4. The RPFAM is accordingly disposed of.
