17. 1. The amount awarded by the learned Civil Judge, Senior Division, Aska, Ganjam in MJC No.94 of 1996 by the impugned judgment dated 3rd September, 2005 works out to only Rs.1,36,334/- inclusive of interest, solatium etc.

2. Learned counsel for the Appellant further informs the Court that the said amount has been deposited in the executing Court, i.e., the Court of learned Civil Judge, Senior Division, Aska in Execution Petition No.8 of 2007 on 24th September, 2012.

3. Having heard learned counsel for the parties, the Court is not inclined to interfere with the impugned order of the learned Civil Judge, Senior Division, Aska.

4. The appeal is accordingly dismissed.

5. The amount will now be released by the executing Court in favour of the Respondent without delay.

6. A copy of this order be sent forthwith to the concerned Court.
