Inadvertently the matter has been listed before this Bench which is an application for leave to appeal under Section 378(1) & (3) of Cr.P.C. against the judgment and order of acquittal passed by the learned Additional Sessions Judge, Bhanjanagar, Aska in S.C. Case No.64 of 1999. In fact it should have been listed before a Division Bench. Accordingly, the Registry is requested to place the matter before Hon'ble the Chief Justice for listing of the same before the appropriate Bench.
