05. 1. Heard Mr. D.C. Dey, learned counsel for the claimant -

Appellant and Mr. A.A. Khan, learned counsel for insurer - Respondent No.2.

2. Present appeal by the claimant has been filed challenging the judgment dated 13th December, 2019 of learned 3rd MACT, Cuttack passed in MAC No.77 of 2016 wherein compensation to the tune of Rs.6,17,515/- along with interest @ 7% per annum from the date of filing of the claim application has been granted on account of injuries sustained by the claimant in the motor vehicular accident dated 6th December, 2016.

3. The main challenge of the claimant - Appellant is for enhancement of the compensation amount. Admittedly the amount

granted by the Tribunal has already been received by the Appellant in the mean time.

4. Having heard both parties and considering the grounds of challenge advanced, a further consolidated amount of Rs.60,000/- is proposed to the parties. This is agreed by Mr. Dey, learned counsel for the claimant and Mr. Khan, learned counsel for the insurer leaves it to the discretion of the Court. As such the amount is fixed to the above extent.

5. In the result the appeal is disposed of with a direction to the insurer - Respondent No.2 to deposit a further consolidated sum of Rs.60,000/- (sixty thousand) before the tribunal within a period of two months from today which shall be disbursed in favour of the claimant

- Appellant.

6. The appeal is disposed of.

7. An urgent certified copy of this order be issued as per rules.
