03. 1. Mr. Mohanta, learned advocate appears on behalf of petitioner and submits, he has filed memo dated 29th November, 2021 for withdrawal of the writ petition with liberty to file afresh. He relies on judgment of the Supreme Court in V.Rajendran v. Annasamy Pandian (D) thr. L.Rs., reported in (2017) 5 SCC 63, paragraph 9. He submits, as declared by the Supreme Court, requirement to make out a case in terms of order XXIII rule 1(3) of Code of Civil Procedure for satisfaction of the Court has been made out by the memo. On query from Court, he submits, notice has not yet been directed.
