Order No. This matter is taken up by hybrid mode. 1 2. Heard learned counsel for the petitioner.
3. This contempt petition has been filed for non compliance of the order dated 06.09.2021 passed in CONTC No. 6625 of 2021, by which this Court had directed that taking into consideration the judgment of Bachan Singh v. The Road Transport Officer, Rourkela, Sundargarh and others, 2009 (II) OLR, 183, the case of the petitioner for transfer of ownership is to be considered by complying Section 51 (5) of the Motor Vehicle Act.
4. Mr. Behera, learned counsel for the Transport Department contended that though the order was passed on 06.09.2021, the same was communicated only on 28.20.2021. After receipt of the order, the opposite party-authority had issued notice to the petitioner and the matter is pending before the authority.
5. In view of the above, the contempt proceeding is dropped.
