03. 12.01.2021 This matter is taken up through Video
Conferencing because of COVID-19 pandemic.
Mr. S. Rath, learned counsel for the appellant
submits that the appellant may be permitted to withdraw
this MATA with liberty to file appeal before the appropriate
appellate forum.
Accordingly, the MATA is allowed to be withdrawn.
The appellant is at liberty to file appeal before the
appropriate appellate forum. The appellant may also file an
application for condonation of delay under Section 14 of the
Limitation Act, 1963.
Certified copy of the impugned judgment be
returned to the learned counsel for the appellant. As Xerox
copy of the same is there in the brief, there is no need to
substitute the copy thereof.
As restrictions are continuing due to COVID-19
pandemic, learned counsel for the parties may utilize the soft
copy of this order available in the High Court's official
website or print out thereof at par with certified copies in the
manner prescribed, vide Court's Notice No.4587, dated
25.03.2020.
