02. 06.01.2021 Due to outbreak of COVID-19, this matter is taken
up through Video Conferencing.
Heard Mr. Somanath Mishra, learned counsel for
the petitioner.
The petitioner in this writ petition prays to quash
the judgment and order dated 20.02.2020 (Annexure-8)
passed by learned Senior Civil Judge, Talcher in C.S.
No.177 of 2019.
Since the petitioner has a remedy under Section 96
of the C.P.C. to assail the said judgment and order, I am
not inclined to entertain the writ petition.
It is open to the petitioner to avail the remedy under
the statute to challenge the judgment and order under
Annexure-8.
Accordingly, this writ petition is disposed of.
Authenticated copy of this order downloaded from
the website of this Court in the manner prescribed in
this Courts Notice No.4587 dated 25.03.2020 shall be
treated at par with the certified copy of this order.
