It appears that an additional affidavit in reply to an objection on the maintainability of the writ petition has been filed by the petitioner without leave of this Court, wherein it has been sought to bring the Article of Association and also for making certain typographical corrections.
Though filing of the affidavit is irregular but in the interest of justice, the same is taken on board. With regard to the typographical errors as indicated in para 6 and 7, the wrong quoting of paragraphs of the cited judgment is not relevant as this is a point of law that has to be argued. With regard to the submission in para 7 of the additional affidavit, Section 2(72) (f) of the Companies Act 2013 as given in the reply affidavit, may be read as Section 2 (72) (iv) of the Companies Act 2013.
