JUDGMENT AND ORDER (ORAL)
1. The petitioner before this Court is the Dorbar Shnong of
Nonghali represented by the Sordar. The grievances as made out in the
writ petition is that the respondent No. 5 had on earlier occasion
demarcated the boundary between two villages i.e. Nonghali and
Mynriang, which was however, altered subsequently by the order dated
29.11.2021 which is impugned herein together with the letter dated
13.10.2021.
2. By the order dated 10.05.2022, this Court had permitted the
learned Senior counsel for the respondent No. 1 to 4 to obtain instructions
on the matter. Today, it is informed to the Court that as against the order
dated 29.11.2021, the proceedings are already before the Executive
Committee, Khasi Hills Autonomous District Council. As such, he
submits this matter before this Court appears to be premature.
3. Mr. H. Nongkhlaw, learned counsel for the petitioner on this
submission fairly concedes that as the District Council has taken up the
matter for consideration, he submits that the petitioner will contest the
matter before the said forum. Accordingly, he prays that directions be
issued that the said proceedings which are now pending, be completed
within a period of 2(two) months, as this matter had already been
conclusively resolved in the year 2015, but dispute has re-arisen due to the
order dated 29.11.2021 passed by the respondent No. 5.
4. In view of the submissions and instructions as received by the
learned counsel for the parties, this matter is closed with the directions to
the Executive Committee, Khasi Hills Autonomous District Council to
complete the entire proceedings within a period of 2(two) months from
the date of receipt of the certified copy of this order. It shall be open to the
petitioner to raise any issue or to produce any document in relation to the
said dispute.
5. The instant writ petition is accordingly disposed of.
