Mr. Th. Mahira, learned counsel appeared on behalf of the appellant and Mr. N. Surendrajit, learned counsel appeared on behalf of respondent No. 1. None appeared on behalf of respondent No. 3, despite service of notice.

It has been submitted by Mr. N. Surendrajit, learned counsel that during the pendency of this appeal, the respondent No. 2 has expired and except for the respondent No. 1, there is no other legal heir of the deceased respondent No. 2.

Mr. Th. Mahira, learned counsel appearing for the appellant submitted that preparation of the paper book has already been completed and the matter can be finally heard.
