When the matter is called up, none appeared on behalf of the appellant. Mr. Th. Henba, learned counsel appeared on behalf of respondent No. 1 and Mr. Shyam Sharma, learned GA appeared for the respondents No. 2 and 3.

Mr. Th. Henba, learned counsel appearing for the respondent No. 1 submitted that as the appellant or his counsel is absent today, the present appeal be dismissed for non-prosecution as the matter has been pending for long time.

As the counsel for the appellant is absent today, no adverse order is passed in the interest of justice.
