Learned counsel for the appellant, Mr. Sanjoy Yambem is present
before this Court physically and similarly, learned counsel for the respondents, Mr.
Th. Baloo is also present before this Court physically.
The proceeding in MC(MAC APP) No. 2 of 2025 has been filed under
the provision of Order XLI Rule 5 read with Section 151 of CPC whereby seeking
for staying the impugned order dated 08.12.2023 and subsequent correction order
dated 15.05.2024 rendered by the Motor Accident Claim Tribunal, Manipur at
Lamphelpat in MAC Case No. 93 of 2022.
The Ld. Tribunal in the proceeding of MAC Case No. 93 of 2022
rendered an award and judgment for a sum of Rs. 96,13,176/- (Rupees ninety six
lakh thirteen thousand one hundred and seventy six) with accrued interest of 6%
per annum on the compensation amount from the date of filing the claim
application. Subsequently, rendered an award and judgment in the same has been
challenged by preferring an appeal in MAC APP No. 2 of 2025. But, in this
miscellaneous case proceeding, ex-parte interim order / staying the award and
Page 1|2 judgement has been sought for. However, the claimant has initiated the
proceeding for seeking compensation and based on the evidence let in by the
claimant and also facilitating the documents for compensation, however based on
the evidence that award has been rendered by the Ld. Tribunal with the interest
of 6% per annum and therefore, the applicant/petitioner in this proceeding be
directed to deposit 75% of the award amount with accrued interest of 6% per
annum and the said amount shall be deposited before the Registry of the High
Court of Manipur within a period of 4 (four) weeks and the amount shall be
invested in any Nationalised Bank until further order.
Accordingly, the order rendered by the Motor Accident Claims
Tribunal, Lamphelpat in MAC Case No. 93 of 2022 dated 08.12.2023 is hereby
stayed.
Consequently, these matters would be listed on 29.08.2025.
