Heard Mr. Kh. Samarjit, learned DSGI assisted by Mr. Nongdamba

Naorem, learned counsel appearing for the appellant and Mr. S. Thoi Thoi Meitei,

learned counsel appearing for the respondent.

At the outset, the learned counsel appearing for the parties jointly

submitted that the impugned judgment and order dated 06.03.2020 passed by the

Special Judge (NIA), Manipur in Cril. Appeal Case No. 6 of 2019 be set aside and

to remand the matter to the said trial Court for reconsideration of the matter afresh

after allowing both parties to file additional facts and evidences.

It has also been submitted that pending consideration and disposal of

the matter, proceeding of the zima be kept in abeyance.

In view of the submission made by the learned counsel appearing for the

parties, the said impugned judgment and order dated 06.03.2020 passed by the

Special Judge (NIA), Manipur in Cril. Appeal Case No. 6 of 2019 is set aside and

the matter is remanded back to the said trial Court for reconsideration.

Both the parties should be allowed to submit additional facts and

evidences before reconsideration of the matter. It is also made clear that pending

reconsideration and disposal of the matter by the Special Judge (NIA), Manipur,

the proceeding of zima shall be kept in abeyance.

With the aforesaid direction, the present appeal is hereby disposed.

Registry is directed to furnish a copy of this order to the Special Court

(NIA), Manipur as expeditiously as possible.
