[1] Heard Mr. N. Umakanta, learned counsel for the

applicants and Mr. Th. Modhu, learned senior counsel assisted by Mr.

Th. Henba, learned counsel on behalf of the respondents.

[2] By the present application, the applicants are praying for

quashing the order dated 06.07.2024 passed by the Ld. Executing

Court in Execution Case No. 1 of 2019 whereby the Executing Court

gave direction to the Deputy Commissioner and Bailiff to execute the

decree. It is prayed that this order may be kept in abeyance till the

conclusion of the present appeal and filing of the second appeal will be

infructuous.

[2] Till the pronouncement of the judgment, the appellants

shall not be evicted from suit land and no demolition of their buildings

in terms of the order dated 06.07.2024 passed by the Executing Court.

[3] It is made clear that there is no stay on the proceeding

for demarcation, if any, in terms of the direction of the Executing Court

for identifying shares of the parties in the suit land.

[4] List these cases on 06.08.2024.
