Mr. Birendrakumar, learned counsel appearing on behalf of the appellant,

states that the latter has passed away during the pendency of the appeal.

In view of the foregoing, the present appeal assailing the impugned

judgment and order dated 07.10.2019 and order of sentence dated 11.10.2019

stands, abated in terms of the provision of Section 394 Cr.P.C.

The present appeal and the pending application are accordingly

disposed of.
