Heard Mr. M. Hemchandra, learned senior counsel assisted by Ms.
Rinika Maibam, learned counsel appearing for the petitioner.
Issue notice, returnable within three weeks.
Mr. H. Samarjit, learned Government Advocate entered appearance
and accepts notice on behalf of the respondents, hence, no formal notice is
called for.
Mr. M. Hemchandra, learned senior counsel submitted that the
issue raised in the present writ petition is squarely covered by judgment and
order dated 25.07.2016, passed by this Court in WP(C) No. 966 of 2015 and
other batches of writ petitions and that the present writ petition can be
disposed of by granting similar reliefs.
Mr. H. Samarjit, learned Government Advocate seeks some time to
go through the said judgment and verify the contention of the learned senior
counsel.
As prayed for, list this case again on 28.03.2023.
It is made clear that pendency of the writ petition will not bar the
authorities from considering and disposing of the Appeal dated 02.01.2023
submitted by the petitioner.
