B E F O R E HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 19-07-2022 Heard Mr. Kh. Tarunkumar, learned counsel appearing for the petitioner, Mr. Shyam Sharma, learned Government Advocate appearing for the State respondents and Mr. S. Suresh, leaned counsel appearing for the respondent No. 2.
It is submitted by Mr. S. Suresh, learned counsel that new facts have been incorporated by the petitioner in the rejoinder affidavit and accordingly, Mr. S. Suresh, learned counsel prayed for granting two weeks' time to file a short reply.
This prayer is vehemently objected to by Mr. Kh. Tarunkumar and submitted that no new facts have been incorporated and that the present case is squarely covered by the judgment of the Apex Court as well as by the judgment passed by this court.
Be that as it may, in the interest of justice, one chance is given to the respondent No. 2 to file a short reply.
As prayed for, list this case again on 11-08-2022. It is made clear that if the respondent No. 2 failed to file their reply as prayed for on or before the next date, this matter will be heard and decided on the basis of the materials available on record.
