                PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act,
                to direct the learned Special Court (PCR Act cases), Sivagangai, to consider the
                bail application of the petitioner concerned in crime No.38/2026 on the file of
                the inspector of Police, Devakottai Town Police Station, Sivagangai District/the
                2nd respondent herein and pass orders in accordance with law on the same day
                of the surrender if any petition filed by the petitioner.

                                                         ORDER

The present petition has been filed by the fourth accused in crime No.38

of 2026 on the file of the second respondent police seeking a direction as

against the trial Court to consider the bail application of the petitioner on the

same day of surrender.

2. Considering the averments in the petition, there shall be a direction to

the learned Special Court (PCR Act cases), Sivagangai, to consider the bail

application of the petitioner on the same day of surrender in crime No.38 of

2026 on the file of the second respondent police after giving due opportunity to

the defacto complainant.

3. With the above said observations, this Criminal Original Petition

stands allowed.
