                                                               *****

                                                              ORDER

1. The petitioner is before this Court seeking issuance of a Writ of

Mandamus directing the fourth respondent to consider the petitioner’s

objection dated 16.02.2026.

2. In the said objection, the petitioner has stated that the standing

trees on the public road abutting the petitioner’s property have been cut

https://www.mhc.tn.gov.in/judis ( Uploaded on: 13/03/2026 02:19:06 pm )

down for the purpose of erecting poles and drawing overhead

transmission lines for transmitting power generated by the sixth

respondent’s windmill farm. The petitioner has further contended that

poles have been erected on a water body and that the overhead electricity

transmission lines have not been drawn in accordance with the approved

alignment plan.

3. The respondents have submitted that the poles have been erected

and the overhead electricity transmission lines have been drawn strictly

in accordance with the plan approved by the competent authority and that

there has been no deviation from the said plan. It is also contended that

the poles have not been erected on the petitioner’s property and that the

overhead lines do not pass through the petitioner’s land. Therefore,

according to the respondents, the petitioner has no locus standi to

maintain the present writ petition.

4. The photographs produced along with the typed set of papers

reveal that the poles have already been erected and the overhead

transmission lines have been drawn, and only the branches of the trees

have been cut or trimmed.

5. In such circumstances, there is no statutory obligation on the

fourth respondent to consider the objection submitted by the petitioner at

this stage. If any damage has been caused to the petitioner’s property, it is

open to the petitioner to approach the jurisdictional Civil Court seeking

appropriate relief, including compensation for damages. Further, the

approved plan for erection of poles and drawing of overhead

transmission lines has not been challenged by the petitioner. In the

absence of such a challenge, the present writ petition is not maintainable.

6. With the above observations, the Writ Petition stands disposed

of. No costs.
