                     PRAYER: Criminal Revision Case filed under Section 438 and 442 of
                     BNSS, 2023, to call for the records pertaining to the judgment dated
                     19.09.2023 in Crl.A.No.340 of 2019 passed by the Learned IV Additional
                     District and Sessions Judge, Coimbatore by confirming the order of Learned
                     Judicial Magistrate, Fast Track Court No.I @ Magisterial Level, Coimbatore
                     in C.C.No.284 of 2014 dated 09.10.2019 and set aside the same by allowing
                     the above Criminal Revision Petition.

                                                                  ORDER

This revision challenges the judgment of conviction and sentence

imposed on the petitioner passed by the learned IV Additional District and

Sessions Judge, Coimbatore in Crl.A.No.340 of 2019 dated 19.09.2023

confirming the judgment dated 09.10.2019 passed by the learned Judicial

Magistrate, Fast Track Court No.I @ Magisterial Level, Coimbatore, in

C.C.No.284 of 2014 dated 09.10.2019, convicting the petitioner for the

offence under section 138 of the Negotiable Instruments Act, 1881 and

sentencing her to undergo six month simple imprisonment and pay a

compensation of Rs.6,00,000/- and in default, to suffer two months simple.

2. Today, the matter was listed to dispense with the judgment passed

by the trial Court.

3. The learned counsel for the petitioner submitted that the petitioner

was arrested on 06.01.2026 pursuant to the impugned judgment and that

thereafter, the parties entered into a compromise; hence, the revision may be

disposed of.

4. Since there was a delay in filing the revision, the delay was

condoned after hearing the complainant's counsel. Further, this Court

directed the Registry to number the revision and list it for hearing after

lunch.

5. When the matter was taken up post lunch, the complainant was

present in person and was identified by her counsel Mr.V.M.Karthik

[Enrolment No.3368/2026]. She has filed an affidavit stating that she

received a total sum of Rs.9,00,000/- (Rupees Nine Lakhs Only) towards

full and final settlement of all her claims. The complainant therefore does

not wish to purse the case.

6. Considering the fact that the parties have arrived at a compromise

and since the offence is compoundable, this Court is inclined to accept the

compromise and set aside the judgment of conviction passed by the trial

Court and confirmed by the appellate Court. Consequently, the judgment of

conviction is set aside and the petitioner is acquitted of the offence under

Section 138 of the NI Act and she is directed to be released forthwith. The

bail bond executed by the petitioner shall stand discharged.

7. In the result, the Criminal Revision Case stands allowed on the

terms of the compromise. Consequently, connected Criminal Miscellaneous

Petition stands closed.
