6. This Court considered the rival submissions made.
7. The petitioners have been implicated only through the confession
statement of the 2nd accused. It is reported that the accused Nos.4 and 6, who
were similarly placed persons, were acquitted by the trial Court. The learned
Additional Public Prosecutor has raised serious objection that both the accused
are having previous cases to their credit as stated above.

in Crl.A.(MD)Nos.277 of 2024 and 827 of 2025
8. Though the learned Additional Public Prosecutor has opposed to grant
bail to the petitioners, considering the period of incarceration undergone by the
petitioners and also considering the fact that the appeals could not be taken up
for final hearing immediately for want of time and the accused Nos.4 and 6,
who were similarly placed accused persons, were acquitted by the trial Court,
this Court is inclined to suspend the sentence with certain conditions.
9. Accordingly, the substantive sentence of imprisonment alone is
suspended pending disposal of the criminal appeal and the petitioners are
ordered to be enlarged on bail on the following conditions:
(i) The petitioners shall execute a bond for Rs.3,00,000/- (Rupees three
lakh only) each, with two sureties each for a like sum to the satisfaction of the
I Additional Special Court for NDPS Act Cases, Madurai.
(ii) The sureties must be respectable Government Servants. The sureties
shall file an affidavit before the respondent Police, by ensuring that the
petitioners will not indulge in any other offence in future and they will be
available during the appeal proceedings.
(iii) The petitioners and the sureties shall submit a copy of their Aadhaar
Card or any other identity card issued by the Government in proof of their

residence address, before the trial Court as well as before the respondent Police.
In the event, if there is any change of address, the same shall be intimated to the
respondent Police without fail.
(iv) The petitioners shall not misuse the liberty granted to them by
indulging in any further offence.
(v) The petitioners shall appear before the respondent Police daily at

offence in future and they will be available for trial in other cases pending
against them and they will also be available for appeal proceedings.
