                      India seeking issuance of a Writ of Mandamus directing the third
                      respondent to consider and dispose of the petitioner's Appeal Petition
                      dated 22.07.2024, by conducting a proper and fair enquiry within a
                      stipulated time period.

                                                             ORDER

This writ petition has been filed seeking issuance of a writ of

mandamus directing the third respondent to dispose of the appeal filed by

the petitioner on 22.07.2024 within a time frame fixed by this Court.

2. Heard Mr.P.Tamilalagan, learned counsel for petitioner and

Mr.D.Ravichander, learned Special Government Pleader appearing for

respondents.

3. The case of the petitioner is that he is the owner of the

subject property and patta also stood in the name of the petitioner in Patta

No.765. The title of the petitioner was also declared by a competent civil

Court in O.S.No.32 of 2016 by judgment and decree dated 16.04.2019.

4. During the pendency of the civil proceedings, the rival

parties had sold the property in favour of third party by concealing the

pendency of civil proceedings. Later, one Maniselvan filed a complaint

before the fourth respondent and the allegation made by the petitioner is

that the fourth respondent, without issuing any notice, proceeded to

cancel the patta that stood in the name of the petitioner. Aggrieved by the

same, the petitioner filed an appeal before the third respondent on

22.07.2024. There was absolutely no progress in the appeal for more than

a year. It is under these circumstances, the present writ petition has been

filed.

5. Taking into consideration the facts and circumstances of the

case and the materials placed before this Court, there shall be a direction

to the third respondent to deal with the appeal filed by the petitioner on

22.07.2024 on its own merits and in accordance with law and final orders

shall be passed after affording opportunity to the petitioner and the said

Maniselvan within a period of eight (8) weeks from the date of receipt of

a copy of this order.
