PRAYER – This Civil Suit is filed under Order VII Rule 1 of the C.P.C. r/w
Order IV Rule 1 of O.S. Rules, (a) seeking for a declaration to hold that the
announcement made by the 3rd Defendant on 21.06.2025 as published in the
Murasoli Daily Newspaper dated 22.06.2025 is arbitrary and illegal stating that
the Defendants 4 to 6 are the President, General Secretary and Treasurer at the
Central level of the 1st Defendant Union and will announce the names of the
remaining office bearers at the Central Union level and the Depot level of the
1st Defendant Union as illegal, malafide, null and void contrary to the Bye-law
of the 1st Defendant, (b) for a Permanent injunction restraining the Defendants
3 to 6, their men, agents, representatives, called in any other manner from and
other persons claiming through or under them from anyway administering the
day today affairs of the 1st Defendant Union, (c) for Mandatory Injunction
directing the 2nd Defendant Federation to conduct the election to the Office
bearership of the 1st Defendant Union both at the Depot Level and the Central
Office level of the 1st Defendant Union as per the ByeLaws of the 1st

JUDGMENT
This Civil Suit is filed by the plaintiffs (a) seeking for a declaration to
hold that the announcement made by the 3rd Defendant on 21.06.2025 as
published in the Murasoli Daily Newspaper dated 22.06.2025 is arbitrary and
illegal stating that the Defendants 4 to 6 are the President, General Secretary

2.When the matter is taken up for hearing, the learned counsel appearing
for the plaintiffs circulated a memo seeking permission of this Court to
withdraw this Civil Suit and made an endorsement to that effect.
3.The learned counsel appearing on behalf of the defendants 2 and 3 to 6
are also present and they submitted that they have no objection to withdraw the
Civil Suit.
4.Recording the submission made on either side and the memo filed by
the learned counsel for the petitioners, this Civil Suit is dismissed as withdrawn.
Consequently, connected Application and Original Application are closed. No
costs. Registry is directed to refund the Court fee to the plaintiff as per law.
