                     Courts Commercial Division and Commercial Appellate Division of

                     High Court Act 4 of 2016:

                                  (a) Direct the defendant to pay the plaintiff a sum of

                     Rs.1,42,66,749/- along with further interest at the rate of 18% per

                     annum on Rs.1,05,01,499/- from the date of filing the plaint till the

                     date of recovery;

                                  (b) Directing the defendant to pay the costs of this suit.

                                                         JUDGMENT

Learned counsel for the plaintiff has submitted a letter dated

10.09.2021 stating that a settlement was arrived at outside Court. For

that reason, learned counsel submits that she has been instructed to

withdraw the suit.

2. The defendant, which is a proprietary concern, is represented

by M.Sivaiah, Proprietor, who is present in person. He concurs that a

settlement was reached.

3. In view of the aforesaid, C.S.(Comm.Div.) No.114 of 2021 is

dismissed as settled out of Court without any order as to costs. Since

the dispute was settled, the Registry is directed to refund the Court

fee.
