Prayer : Writ Petition filed under Article 226 of the Constitution of India for
issuance of a Writ of Mandamus, directing the respondents to revoke the order of
suspension issued by the 2nd respondent dated 21.7.2023 and to reinstate the
petitioner into service in the light of the judgment rendered in Honourable Supreme
Court of India in Ajaykumar Chowdary case reported in (2015) 7 SCC 291 based
on the representation dated 7.8.2024 submitted by the petitioner with all monetary
and service benefits.

ORDER
This writ petition has been filed for issue of writ of mandamus directing the
respondent Bank to consider the representation submitted by the petitioner on
07.08.2024 and to revoke the order of suspension issued by the 2 nd respondent
dated 21.07.2023 and to reinstate the petitioner into service.
2.Heard Mr.S.Nedunchezhiyan, learned counsel appearing on behalf of the
petitioner and Mr.P.Haribabu, learned Standing Counsel appearing on behalf of the
respondents.
3.The petitioner was working as an Assistant in the respondent Bank. The 2 nd
respondent through proceedings dated 21.07.2023 placed the petitioner under
suspension on grave charges contemplated against the petitioner.

4.The petitioner submitted a representation dated 07.08.2024, requesting the
respondent Bank to revoke the order of suspension and to reinstate the petitioner
into service. Since the same was not considered, the present writ petition has been
filed before this Court seeking for appropriate directions.
5.Taking into consideration the facts and circumstances of the case and also
the limited relief sought for by the petitioner and without going into the merits of
the case, there shall be a direction to the 2 nd respondent to deal with the
representation made by the petitioner on 07.08.2024 on its own merits and in
accordance with law and take a decision, within a period of eight weeks from the
date of receipt of copy of this order.
6.This writ petition is disposed of with the above directions. No Costs.
