PRAYER: Petition filed under Article 226 of the Constitution of India, to
issue a Writ of Mandamus to direct the respondents more particularly
the first respondent to register the sale deed dated 15.12.2023 presented
by the petitioner for registration in respect of the house site in Plot NO.
173 in Survey No.174/3P situated at Kunnakkudi Village, Karaikudi
Taluk, Sivagangai District by considering the representation received on
03.06.2024 within a time frame.

ORDER
This Writ Petition has been filed for issuance of Writ of
Mandamus to direct the respondents more particularly the first
respondent to register the sale deed dated 15.12.2023 presented by the
petitioner for registration in respect of the house site in Plot NO.173 in
Survey No.174/3P situated at Kunnakkudi Village, Karaikudi Taluk,
Sivagangai District by considering the representation received on
03.06.2024 within a time frame.
2. After presentation of the sale deed for registration, the second
respondent raised objections before the first respondent for registration
of the sale deed, which was presented by the petitioner alleging that the
subject property was obtained in the proceedings initiated. However, the
second respondent did not produce any copy of the judgment in respect
of the subject property.

3. In view of the above, the first respondent is directed to conduct
enquiry after issuing notice to the petitioner and the second respondent
and after giving opportunity of hearing and pass orders on merits and in
accordance with law within a period of four weeks from the date of
receipt of a copy of this order.
4. With the above direction, this Writ Petition is disposed of. No
costs.
