This matter was listed for hearing on 06.08.2024 when the

representing counsel made a request that the appellant would not pursue

the matter and that an endorsement would be made by learned counsel

on record. Though passed over for the representation, there was no

representation when the matter had been called in the afternoon. Hence it

was directed to be listed today under the caption 'for dismissal' when also

there is no representation on behalf of either party.

2. Hence this civil miscellaneous appeal is dismissed for non-

prosecution. No costs. Connected miscellaneous petition is closed.
