                                                         JUDGMENT

Earlier, this matter was posted on 01.09.2023, this Court has

directed to implead the legal heirs of the appellant and hence, the matter

was directed to be posted on 08.09.2023 (today) finally.

2. When the matter is taken up for hearing today (08.09.2023),

the learned counsel for the appellant reported that the appellant was died

and he is unable to substitute the legal heirs in this matter. He also stated

that there is no further instruction in this matter.

3. Recording the same, this Civil Miscellaneous Appeal stands

dismissed as abated. No costs.
