                                                          JUDGMENT

[Judgement of the Court was delivered by R.MAHADEVAN, J.]

Assailing the order dated 06.03.2023 passed by the learned Judge in

W.P.No.6409 of 2023, the petitioner has come up with the present appeal.

2. When the matter was taken up for hearing, the learned Senior

Counsel appearing for the appellant sought permission of this Court to

withdraw this appeal, stating that subsequent to the order impugned herein,

the first respondent has passed an order dated 09.03.2023, which, the

appellant is inclined to challenge before the competent authority in the

manner known to law. He has also made an endorsement in the court bundle

to that effect. Further, the learned senior counsel prayed for an interim

protection until the appellant approaches the competent authority by filing

necessary appeal, for which, the learned counsel appearing for the

respondents has no serious objection.

3. In view of the above, permission is granted and the appeal is

dismissed as withdrawn. However, the appellant is granted two weeks time

to file necessary appeal before the competent authority by placing all its

objections. Till such time, no recovery shall be made against the appellant.

No costs. Consequently, connected miscellaneous petition is closed.
