[Judgment of the Court was delivered by S.S.SUNDAR, J.,] (1) This matter appeared earlier under the caption ''Default Cases'' as

Registry has noted that batta with want of correct address due

regarding the sole respondent.

(2) This Court gave two weeks time to report compliance. Despite this

matter appears in the list, the Registry has reported that the learned

counsel for the appellant had not taken steps to pay batta and

furnish the correct address of the sole respondent.

(3) This Court has already observed that the appeal suit will be

dismissed for non prosecution if no steps are taken.

(4) Having regard to the fact that the learned counsel for the appellant

has not reported compliance, this Appeal Suit stands dismissed as

against the sole respondent. No costs. Consequently, connected

miscellaneous petition is closed.
