The learned counsel appearing for the appellant seeks

permission of this Court to withdraw the second appeal. He filed a memo

dated 16.06.2023 and also made an endorsement to that effect.

2. In view of the memo and endorsement made by the learned

counsel appearing for the appellant, this Second Appeal is dismissed as

withdrawn. No costs. Consequently, connected Miscellaneous Petition is

closed.
