W.P(MD)No.14671 of 2023

The Writ Petition has been filed in the nature of mandamus seeking a

direction to the first respondent, Revenue Divisional Officer, Iluppur at

Pudukkottai District, to dispose of an appeal filed by the petitioner in

Na.Ka.No.A3/4717/2022 on 30.09.2020. The petitioner had given a

representation on 11.05.2023.

2. Since the enquiry is now pending before the first respondent, it may

not be appropriate on the part of this Court, to go into the merits of the case.

But it is seen that the petitioner and his other co-owners had filed O.S.No.16 of

2012 before the Sub Court at Pudukkottai and a declaration had been issued by

the said Court, relating to title by judgment dated 03.04.2023. The first

respondent may take into consideration all these facts and endeavour to dispose

of the appeal on or before 31.10.2023.

3. This Writ Petition is dismissed. No costs. Consequently, connected

miscellaneous petition stands closed.
