                     PRAYER: Civil Suit filed under Order XXIV Rule 1 & 2 of Madras High
                     Court O.S.Rules read with Order VII Rule 1 of CPC & 151 CPC, praying to
                     pass a decree and judgement,against the defendants 1 to 3 and each one of
                     them
                                  (a)for partition and separate possession of the plaintiff's one fourth
                     share of the properties set out in schedule 'A' to 'D' properties of the plaint
                     and directing the defendants to hand over the possession of the same to the
                     plaintiff;
                                  (b)to direct the defendants 1 to 3 and each one of the defendants to
                     render account of the amounts invested in FDs in the name of late
                     T.M.Rangarajan and in their name of defendants 1 to 3 and any one of them
                     and in respect of income and rents received by defendants from Schedule A,
                     B & C properties and to pas a decree for the amount so ascertained and to

                     pay the plaintiff's one-fourth share thereon.
                                  (c) to direct the defendants to pay the cost of the suit
                                  (d) and to pass such further reliefs as this Court may deem fit and
                     proper in the circumstances of the case.

                                                             JUDGMENT

When the matter is taken up today for hearing, the learned counsel for

the plaintiff submitted that he is not able to secure any particulars of legal

heirs of the deceased plaintiff and that the plaintiff died as early as in

February-2020 and the suit is abated.

2. Recording the same, this Civil Suit is dismissed as abated due to

the death of the plaintiff.
