                                                   JUDGMENT

Today, when the matter is taken up for hearing, Mr.Jayamalan,

representing counsel on behalf of the counsel for the appellant on record

submitted that the bundle is misplaced and he seeks for an adjournment.

2.A perusal of the earlier orders passed by this Court shows that

already several adjournments have been granted in the present Second

Appeal. In fact, on 12.06.2023 there is no representation for the appellant

and therefore, the matter is listed under the caption "for dismissal" since

today also there is no representation for the appellant. The Second Appeal

is of the year 2011 and hence, I do not find any reason to keep the appeal

pending.

3. In view of the same, the Second Appeal is dismissed for non

prosecution. No costs. Consequently, connected Miscellaneous Petition is

closed.
