                                                     JUDGMENT

(Judgment of the Court was made by R.SUBRAMANIAN, J.)

This appeal is directed against the order made in

W.P(MD)No.2409 of 2023 dated 07.02.2023. The said writ petition

was filed against the order of the District Educational Officer,

Tiruchirappalli, dated 05.01.2023, in and by which, the 6th

respondent being the senior most P.G Assistant in the school was

placed as Headmaster(in-charge) while placing the school under

direct payment. There is a dispute regarding the appointment of the

appellant as the Headmaster of the school by the school committee

way back on 13.10.2019 that will have to be separately resolved.

2. Insofar as this appeal is concerned, nothing survives in

this appeal as of today, since the appellant himself has attained the

age of superannuation on 30.06.2022. Even though the appellant

continued to function as Headmaster till the impugned order dated

05.01.2023 came to be passed, since he retired from service, the 6th

respondent is now functioning as in-charge Headmaster.

3. In view of the subsequent developments, without

prejudice to the decision on the question as to whether the appellant

was validly appointed as Headmaster or not, this writ appeal is

dismissed as having become infructuous. No costs. Connected

miscellaneous petition is closed.
