                     the file of the Motor Accidents Claims Tribunal/Additional District
                     Court(Fast Track Court), Additional District Judge, Kumbakonam
                     and to dismiss the claim petition.

                                  When   the   matter   is   taken   up   for   admission    in   the

                     morning,there is no representation on behalf of the appellant either

                     in person or through counsel and hence the matter is passed over

                     and again when the matter is called at 2.30 p.m., none appeared

                     on behalf of the appellant. This shows that the appellant is not

                     interested in prosecuting the appeal further. Hence this Court has

                     no other option except to dismiss the appeal for non-prosecution.



                                  2.Accordingly, the Civil Miscellaneous Appeal is dismissed for

                     non-prosecution. No costs. Consequently, connected Miscellaneous

                     petition is closed.
