                 file of the learned Subordinate Judge, Ambasamudram reversing the judgment
                 and decree dated 20.04.1990 made in O.S.No.107 of 1985 on the file of the
                 Additional District Court, Ambasamudram.

                                                          JUDGMENT

The appeal has already been dismissed on 13.08.2019 against the third

respondent for non payment of batta. The application in C.M.P(MD)No.5704 of

2020 has been filed to condone the delay of 210 days in setting aside the order

dated 13.08.2019 passed in S.A.No.1111 of 2009 dismissing the above appeal for

non-payment of batta for R3. First respondent already died, steps are taken.

2. Pending application R2 & R4 died and the steps were not taken.

Therefore, the second appeal is dismissed as abated and consequently, connected

C.M.P(MD)No.5704 of 2020. No cost.
