(Judgment of the Court was delivered by R.SURESH KUMAR, J.)

This writ appeal has been directed against the order passed by the writ

Court dated 09.07.2015 in W.P.No.20362 of 2015.

2. Today, when the appeal is taken up for hearing, learned Special

Government Pleader would submit that, though this appeal has been filed

against the order passed by the learned single Judge, when a contempt

petition was filed for the alleged non compliance of the order and it was

pending, the case of the writ petitioner having been considered instead of

Driver post, he was given Mali post, which he has accepted and he has been

working as Mali. In this regard, with regard to the withdrawal of the

contempt petition, he has given a letter to the District Forest Officer on

23.07.2017, which reads thus,

3. Relying upon this communication, the learned Special Government

Pleader would submit that, in view of the satisfaction expressed by the writ

petitioner, as he was appointed as Mali and has been continuously working,

nothing to be persuaded further in this appeal and therefore, he wants

dismissal of this writ appeal.

4. The statement has been brought to our notice by the learned Special

Government Pleader. In view of the said statement made by the writ

petitioner, taking note of the aforesaid development, where the writ petitioner

has been given alternative post, with which when he was satisfied, we feel

that no useful purpose would be served in proceeding further with this writ

appeal. Hence, the same is dismissed. No costs. Consequently, connected

miscellaneous petition is also dismissed.
