JUDGMENT
(Judgment of the Court was delivered by DR.ANITA SUMANTH, J.)
Read this order in continuation of and in conjunction with
order dated 04.07.2023, reading as follows:
“A day time is sought and granted to Mr.D.Shanmugaraja Sethupathi, learned Counsel for the third respondent to commit in writing to the payment of Rs.75,000/- and the preferred scheme of instalments.”
2.Today, an affidavit is filed by the Special Officer, SP.SPL.37,
Malli Primary Agriculture Co-operative Credit Society Limited,
Virudhunagar District, wherein, at Para No.4, while setting out the severe
financial crisis that the Society is currently facing, they undertake to
remit a sum of Rs.75,000/- towards interest for belated payment of
earned leave encashment and salary arrears, as full and final settlement.

3.A copy of this affidavit has been handed over to the learned
appellant's Counsel for onward transmission to the appellant. On
instructions, learned appellant's Counsel states that this arrangement
satisfies the appellant subject to the scheme of installments being
expedited as far as possible.
4.Since the appellant is a super senior citizen, aged 73 years as
on date, let the payment be expedited as far as possible. In any event, it is
made clear that it shall not extend the period of six months as undertaken
and recorded. The first installment shall be paid on the first day of
August 2023, on which date, the appellant shall receive the same in the
office of R3.
5.Recording the above, this Writ Appeal is closed. No costs.
Consequently, connected miscellaneous petition is closed.
